Please carefully read these Terms and Conditions of Use ("Terms") before purchasing any MCLE On Demand products or services (“Services”) through this website (“Site”).  The Federal Bar Association, San Diego Chapter ("FBA SD") offers the Services subject to these Terms.  If you do not agree to these Terms, do not use the Services.

Content Restrictions.  The Services include programs, content, materials, or other information provided through the Site ("Content").  By using the Services, you agree to abide by any restrictions for the Content.  You agree to only use the Content for your personal educational use.  Except for your personal educational use, you agree to not copy, download, transmit, sell, publish, or otherwise distribute any of the Content without the prior written consent of FBA SD.  By using the Services, you do not acquire any intellectual property rights for the Content.

MCLE Certificates.  By following the instructions on the MCLE On Demand webpage, you will be able to receive by email an MCLE Certificate for each individual program you complete.  FBA SD will not issue an MCLE Certificate for any jurisdiction other than California.

A program is considered complete once you have viewed the program and submitted a request for an MCLE Certificate.  You are responsible for completing each program and obtaining the MCLE Certificate before your MCLE compliance deadline.  An MCLE Certificate will not be backdated for any reason.

DISCLAIMER OF WARRANTIES.  THE CONTENT AND SERVICES ARE PROVIDED ON AN "AS-IS" BASIS, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.  THIS DISCLAIMER INCLUDES, BUT IS NOT LIMITED TO, ANY WARRANTY AS TO THE QUALITY, RELIABILITY, TIMELINESS, USEFULNESS, SUFFICIENCY, ACCURACY, AVAILABILITY, OR ABILITY OF THE SERVICES OR CONTENT TO MEET YOUR NEEDS.  ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION ALL IMPLIED WARRANTIES OF CONDITION, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED BY FBA SD.  FBA SD DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES REGARDING THE ACCREDITATION STATUS OF THE CONTENT BY ANY STATE BAR OR OTHER ACCREDITING ORGANIZATION.  YOU EXPRESSLY ASSUME THE RISK AS TO THE ACCURACY, COMPLETENESS, AND ACCREDITATION STATUS OF THE SERVICES AND CONTENT.

LIMITATION ON LIABILITY.  TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF FBA SD FOR ANY CLAIM UNDER THESE TERMS OR ANY CLAIM ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR CONTENT IS LIMITED TO THE AMOUNT YOU PAID TO USE THE SERVICES.  FBA SD SHALL NOT BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT ARISE FROM OR RELATE TO THE USE OF THE SERVICES OR CONTENT.
