Rule 702 Reloaded: Expert Testimony After the 2023 Amendments

On April 21, 2026, the San Diego Federal Bar Association hosted a presentation titled, "Rule 702 Reloaded: Expert Testimony After the 2023 Amendments," with nearly 80 guests in attendance. The program featured the Honorable Todd W. Robinson, U.S. District Judge for the Southern District of California; Patrick Swan, Assistant U.S. Attorney; and Leila Morgan, Federal Defender.
Judge Robinson discussed the historical background of Rule 702 and he provided practice tips for attorneys litigating this rule in his courtroom. AUSA Patrick Swan and Federal Defender Leila Morgan tackled the prosecutorial perspective and defense perspective, respectively. Each also provided practical tips that they have learned in their vast experience litigating expert testimony admissibility in federal court.
