Trivia: Which Supreme Court case from San Diego addressed limitations on the Sixth Amendment right to choose your own lawyer?

 

Feature:

With the New Year comes new opportunities to serve the more than 425 members of the San Diego FBA. For 2022, Dylan M. Aste will lead the FBA’s thirteen-member Board of Directors. Dylan Aste assumes the role of President after volunteering throughout the organization. He is an Assistant United States Attorney in the U.S. Attorney’s Office for the Southern District of California, where he focuses on prosecuting civil claims involving opioid diversion and health care fraud. Meet the Chapter’s President and learn what to expect from the FBA this year, including increased engagement, a charity golf tournament, and a and mentorship program.

 

Chapter Updates:



The FBA worked with Judge Gonzalo P. Curiel and Magistrate Judge Barbara L. Major to present the Civil Discourse and Difficult Decisions Program to high school students from San Diego Unified. This Program brings students into federal courtrooms to observe, learn, and practice the civil discourse and decision-making skills that are needed in the law and in life.

With the California MCLE compliance reporting deadline around the corner, the San Diego FBA has added even more offerings to its MCLE On Demand webpage. Consider supporting the Chapter while catching up on any last-minute credits.

Community and National FBA Updates:


Judge Ohta fills the seat formerly held by the Hon. Barry Ted Moskowitz, who took senior status in December 2017. Before her appointment, Judge Ohta was a Superior Court Judge for the County of San Diego, a Supervising Deputy Attorney General for California, and a two-time judicial law clerk for Judge Moskowitz. The FBA welcomes her back to the Southern District.


Judge Lopez fills the seat held by Hon. Roger T. Benitez, who likewise took senior status in December 2017. Judge Lopez, a former San Diego FBA Board Member, has served as a U.S. Magistrate Judge since October 2018. She previously worked as a Senior Trial Attorney for the Federal Defenders of San Diego, Inc.


The National FBA shares updates on judicial nominations, judicial financial disclosures, and amendments to the Federal Rules.

 

Answer: Wheat v. United States, 486 U.S. 153 (1988), where the defendant's chosen attorney had represented other defendants charged in the same conspiracy. The Court held the presumption in favor of a defendant's counsel of choice may be overcome by the possibility of a serious conflict of interest.
